We use all reasonable endeavours to provide you with the service. The service is dependent on numerous other parties. We cannot therefore guarantee that the service will be available at all times, or without interruption, or will be error free.

The service is provided to you on an “as is” basis and all warranties, representations, conditions and such other similar terms implied by statute or common law are, to the fullest extent permitted by applicable law, excluded.

Liability

Except as expressly and specifically provided in these terms you are solely responsibility for your use of our website and the service. We shall have no liability for any damage caused by errors or omissions in any information, instructions or scripts provided to us by your account providers in connection with the service.

Nothing in this agreement is intended to exclude our liability for matters which the law states cannot be excluded by contract such as liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to the above:

10. The country laws that apply to disputes

Please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
